1.2Website – This website, operated and maintained by Setup Type.
1.3User – The individual accessing or using the Website, or the company, or other legal entity on behalf of which such individual is accessing or using the Website.
1.4Fonts — Software files containing digital typeface, in type and amount specified on the Sales receipt.
1.5Customer – The individual who has purchased a license to use the Fonts, or the company, or other legal entity on behalf of which such individual is purchasing a license to use the Fonts.
1.6License – A written document containing terms of the applicable End User License Agreement (“EULA”) governing use of Fonts offered on this Website.
2.1Setup Type offers this Website, including all information, documents, products, or services available from this Website to the User, conditioned upon User’s acceptance of all Terms and Conditions.
2.2Any new features added to the Website shall also be subject to these Terms and Conditions. User can review the most current version at any time on this page. Setup Type reserves the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to the Website. User’s continued use of or access to the Website following the posting of any changes constitutes acceptance of those changes.
2.3In case these Terms and Conditions conflict with the terms of any agreement individually negotiated and agreed between Setup Type and User, the terms of the latter shall prevail.
2.4This Website is controlled by Setup Type from its offices in the Slovak Republic. By accessing this Website, the User and Setup Type agree that all matters relating to their access to, or use of, this Website shall be governed by the statutes and laws of the Slovak Republic, without regard to the conflicts of laws principles thereof.Setup Type makes no representation that information, documents, products, or services available on this Website are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this Website from other locations do so on their own initiative and are responsible for compliance with local laws.
3.1Setup Type retains the right to modify, update, improve the contents of the Website at any time. Setup Type does not warrant the correctness of information provided on the website and will not be liable for any failure to update such information.
4.1The information, documents, products, or services made available through the Website are and shall remain the property of Setup Type and are protected by copyright, trademark, patent, and/or rights and laws. 5.1This Website may contain links to third-party websites or services that are not owned or controlled by Setup Type. Setup Type is not responsible for their content. Setup Type provides these links for the User as a convenience and the User agrees that their use of any third-party websites is at their own risk.
7.1The information contained on this Website is for general information purposes only. The information is provided by Setup Type and whilst Setup Type endeavours to keep the information up-to-date and correct, Setup Type makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Website or the information contained on the Website for any purpose. Any reliance User places on such data is therefore strictly at their own risk.
7.2In no event will Setup Type be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this Website.
8.1The Fonts may be returned or refunded only if defective and Setup Type is notified within 7 days of the purchase.
8.2The Customer is required to review the content of the cart to ensure that the correct Fonts and Licenses have been selected before purchase.
8.3Should the Customer encounter an unexpected problem with the order, Setup Type should be contacted immediately by e-mail.
9.1Fonts will be repaired or replaced only if defective. To make a warranty claim, the Customer must notify Setup Type by e-mail within 7 days of the purchase. Warranty shall not be applied to converted, modified or otherwise changed Fonts.
9.2Warranty does not cover assurance of performance, result or marketability of product using the Fonts nor applicability of the Fonts for particular purpose.
9.3Setup Type is not obliged to compensate for the Fonts or return the paid amount, if the malfunction was caused by accident, abuse or loss of the Fonts as a result of theft, natural disaster, or negligence. Setup Type is in no event liable for any consequential, indirect, incidental, criminal or other specific damages.
10.1Setup Type does not pay VAT.
10.2VAT is not charged to Customers located in the European Union who are not registered for VAT, customers located outside the European Union, and private individuals.
10.3Customers based in European Union who are registered for VAT need to provide a valid VAT ID during the checkout process, in which case they are charged 0 % VAT and need to declare and pay the associated VAT (the so-called ‘reverse charge’ procedure) in their country.
11.1Setup Type accepts all payment types (bank transfer payments, credit/debit card) via payment service provider GoPay. The Customer may be requested to accept GoPay’s policies before proceeding with their payment. Setup Type does not accept cheques.
12.1Select Fonts and Licenses you wish to purchase and proceed to check out.
12.2Fill in your purchase and invoice details and finalise the order. You have to agree to the terms of License to proceed.
12.3Once you have paid for your order, you will be redirected to a page where you can download your fonts.
12.4If you have paid by bank transfer, the Fonts will be e-mailed to you after the payment is confirmed. In case of problems with downloading, uncompressing of the files, or other technical problems, please contact Setup Type immediately.
13.1Setup Type processes the Customer’s or the User’s personal data to the extent, in the manner and for the purposes which comply with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on free movement repealing Directive 95/46/ES (General Data Protection Regulation) and Law no. 18/2018 Coll. on the protection of personal data and on the amendment of certain laws.
13.2Setup Type does not store any financial or credit card information on its servers.
13.3Customers’s contact and order information is stored for the sole purpose of managing their account and purchases. Setup Type does not not sell or make otherwise available the information about its customers to third parties.
13.4The Customer’s or User’s name and e-mail address may be used to send recurring newsletters only with the express consent. For this purpose, Setup Type uses MailChimp service.

What is a license?
The license grants the licensee the right to use the fonts. The licensee is not the owner of the fonts. The license specifies the terms and conditions of use of the fonts and is a legally binding agreement between the author of the fonts and the licensee.
In the event that the actual use of the fonts exceeds the conditions established at the time of purchase of the license, the licensee is obliged to update the license.
Who needs to license fonts?
Every person or organization who uses the fonts or documents and products containing the fonts must purchase a license – in most cases this is the client, not the designer.
However, there are particular use cases, when a designer creates a one-off standalone product for a client, e.g. a poster, book cover, or a typographic illustration — in such situations it is the designer, who needs to purchase the license.
